Family Office Definition: Marital Trust

Marital Trust definition:  A marital trust transfers your estate to a spouse, while also protecting the inheritance for your children.  The surviving spouse is not permitted to leave the inheritance to a future spouse or future children. The marital trust qualifies for the marital deduction and is exempt from both estate taxes and gift taxes.  However, estate taxes may apply to the trust amount when the surviving spouse dies.
